A partir del finalismo, la teoría del delito estableció que el dolo y la culpa eran parte de los elementos subjetivos del tipo, considerando al dolo como el conocimiento de los elementos de tipo objetivo y la culpa como la infracción al deber de cuidado, es decir que el deber de cuidado pasa a ser un elemento integrante del delito culposo, como consecuencia, no es suficiente con que exista un resultado típico, previsible y evitable sino que es necesaria la infracción al deber objetivo de cuidado. En este sentido, el deber de cuidado debe definirse en base a un criterio mixto, teniendo en cuenta que debe valorarse tanto el cuidado que un hombre consciente y prudente haya tenido (deber objetivo de cuidado), como las capacidades y conocimientos del autor en concreto (deber subjetivo de cuidado). Así, en el delito imprudente se obliga al sujeto a conocer las consecuencias de su conducta, a diferencia de los delitos dolosos, en el que se obliga al sujeto a desistir de la realización de su conducta.
Abstract:
Since the origin of finalism, the crime theory establishes the deceit and negligence were subjective elements of the type, considering the deceit like the knowledge of the objective elements of type, and the negligence like the violence of duty of care, it means that the duty if care is an element that integrates the deceitful crime, in consequence, is not enough with the existence of a typical result, predictability and avoidable but is necessary the violence of the duty of care. In this sense, the duty of care has to be defined in base of a mixed approach, considering that has to be valued the care that a conscientious and prudent man have had (subjective duty of care), and the skills and knowledge of the specific author (objective duty of care). So, in the reckless crime it obligates the man to know the consequences of the act, unlike the deceit crime which the subject is forced to give up the performance of his behavior.
